UPC Local Division: Alternative method of service

An action to a company established in Poland could not be served by post successfully. The Court orders an alternative method of service at the request of the claimant. The claimant is authorized to arrange service by (i) a French bailiff in accordance with Article 8 of EU Regulation 2020/1784 or (ii) by a French bailiff via direct contact with a local Polish bailiff, or (iii) the preparation of bailiff's reports for dispatch by a representative of the claimant, using two established private delivery services that operate independently of each other, for personal delivery against receipt, using the tracking tools of these private delivery services (Paris Local Division, UPC 12 February 2024, CFI 495/2023).
