UPC-Court of First Instance: Procedural decision on the protection of confidential information

In response to a request to protect confidential information, the defendant requested that the court permit the disclosure of confidential information in parallel proceedings between the same parties before the Munich I Regional Court. The information concerned standing to sue and, according to the defendants, was highly relevant to nearly identical arguments in both proceedings. The mere assertion of nearly identical arguments regarding standing to sue and the high relevance of documents in parallel proceedings is not sufficient to lift confidentiality. The request is denied (LD Düsseldorf, 9.9.2025, CFI 100/2024 & CFI 411/2024).
